These Terms of Service apply to Design Shake’s monthly graphic design subscription. By subscribing to Design Shake, you agree to the terms below.

1. Scope of Service

Your Design Shake subscription provides ongoing graphic design support across areas including:

Brand design
Campaign design
Social media graphics
Presentation design
Reports, guides and documents
Digital advertising
Email and digital assets
Event materials
Print design
Marketing and sales collateral

Design Shake may decline requests that fall outside the normal scope of the service or require specialist services not offered by Design Shake.

2. Full Access Subscription

Design Shake offers one Full Access subscription at £795 per month.

You may submit as many design requests as you like. Requests are worked through one at a time, in the order you choose.

“Unlimited requests” means there is no limit on the number of requests you may add to your queue. It does not mean unlimited simultaneous work or unlimited output within a particular period.

Design Shake deliberately works with a limited number of clients at any one time to maintain consistent quality and reliable turnaround.

3. Turnaround Times

Turnaround depends on the complexity and scope of each request.

A straightforward task may take around an hour, while larger or more detailed projects may take several days or up to approximately one working week.

These timings are guides rather than guaranteed deadlines.

Where possible, you will be given an indication of the expected turnaround when work begins.

Urgent or time-sensitive requests may be prioritised where availability allows, but expedited delivery cannot be guaranteed.

4. Submitting Requests

Requests can be submitted through the agreed communication method, including:

Email
WhatsApp
Zoom or video call where appropriate

Requests may include written briefs, links, reference material, copy, images and other files required to complete the work.

Clients are responsible for providing the information and assets reasonably required to complete each request.

Where several requests are waiting, you may choose which request should be worked on next.

5. Design Software & Editable Files

Design Shake primarily works using:

Figma
Canva
Affinity

The software used will depend on the requirements of the project and the format needed for final delivery.

Where appropriate, Figma and Canva projects may be supplied as editable or collaborative files.

Affinity source files may also be supplied where relevant.

Editable files are provided in the software in which the project was originally created. Design Shake is not responsible for compatibility issues caused by third-party software, software updates or clients attempting to open files using unsupported applications.

6. File Delivery & Ownership

Final artwork will normally be supplied in appropriate industry-standard formats such as PNG, JPG or PDF.

Once the relevant subscription payment has been made, completed work created specifically for the client belongs to the client.

This does not transfer ownership of:

Third-party fonts
Stock imagery
Licensed assets
Templates
Plugins
Software
Other third-party intellectual property

Any third-party material remains subject to its original licence terms.

Design Shake may retain backup copies of project and source files for safekeeping but does not guarantee permanent storage. Clients should keep their own copies of final files.

7. Client-Supplied Content

You confirm that you have permission to use any logos, photographs, copy, fonts, trademarks, graphics or other materials supplied to Design Shake.

Design Shake is not responsible for copyright, trademark or licensing claims resulting from materials supplied by the client.

The client remains responsible for checking and approving final artwork before publication, printing or distribution.

8. Billing & Subscription

The Full Access subscription costs £795 per month.

Subscriptions are billed monthly in advance and operate on a rolling monthly basis with no minimum contract term.

Payment covers access to the Design Shake service for the relevant billing period rather than a guaranteed number of hours, projects or completed designs.

Unused time or capacity does not roll over into future billing periods.

9. Cancellation

You may cancel your subscription at any time.

Cancellation will take effect at the end of your current paid billing period.

Where possible, cancellation should be requested at least seven days before your next renewal date.

No further subscription payments will be taken after cancellation has taken effect.

Any work already completed remains yours in accordance with these terms.

10. Pausing Your Subscription

You may request to pause your subscription when you do not require active design support.

While paused:

No design work will be carried out
Billing will be paused
Outstanding requests will remain inactive

Because Design Shake works with a limited number of clients, immediate availability when resuming a paused subscription cannot always be guaranteed.

Where capacity is available, your subscription can resume immediately. If Design Shake is at capacity, you may need to wait until a client space becomes available.

Your new billing cycle will begin when your subscription resumes.

11. Refunds

Subscription payments are non-refundable once a billing period has started.

This includes situations where the client does not submit enough work to make full use of the service during that month.

If Design Shake is unable to provide the service for a substantial period due to circumstances on our side, an appropriate pause, extension or other reasonable solution will be offered.

12. Revisions

Reasonable revisions are included within the subscription.

Revisions to the active request will normally be completed before work moves onto the next request.

A significant change in direction or scope may be treated as a new design request rather than a revision.

13. Communication & Working Hours

Design Shake can be contacted by:

Normal working hours are:

Monday to Friday, 9:00am–5:00pm UK time

Messages may be sent outside these hours but a response should not be expected until the next working period.

If Design Shake is unavailable because of holiday, illness or another significant interruption, affected clients will be notified wherever reasonably possible.

Where appropriate, the subscription may be paused or adjusted to account for extended periods of unavailability.

14. Third-Party Services

Design Shake may use third-party services in the course of providing the service, including design software, cloud storage, stock asset libraries and communication platforms.

Design Shake is not responsible for:

Temporary outages
Platform changes
Losses caused by third-party software
Changes to third-party pricing or licensing
Limitations imposed by those services

15. Printing & Production

Where artwork is supplied for external printing or production, the client is responsible for approving the final files before placing an order.

Design Shake is not responsible for errors, delays, colour variation, manufacturing issues or other problems caused by external printers, manufacturers or suppliers.

Where possible, print-ready artwork will be prepared to the specifications supplied by the chosen provider.

16. Ethics & Restrictions

Design Shake reserves the right to refuse work that is:

Illegal
Fraudulent or deliberately misleading
Abusive, hateful or offensive
Infringing on another party’s intellectual property
Otherwise inappropriate for Design Shake to produce

Design Shake may also end a subscription where the working relationship becomes abusive, unreasonable or unsuitable.

17. AI-Generated Content

Design Shake does not use AI-generated creative work as a substitute for professional design unless its use has been discussed or specifically requested.

AI tools may occasionally be used where appropriate for supporting tasks, ideation or production assistance.

Where third-party AI tools are specifically used to generate client-facing creative assets, this can be discussed with the client where relevant.

18. Liability & Approval

Design Shake is not responsible for losses resulting from:

Errors approved by the client
Incorrect information provided by the client
The way completed designs are subsequently used
External printing or production
Third-party platforms or software
Changes made to supplied artwork after delivery

Clients should carefully review spelling, prices, contact information, dates, legal wording and other important information before approving artwork.

Approval of a design means the client accepts responsibility for the content contained within it.

19. Conduct & Collaboration

Design Shake aims to provide a straightforward, respectful and collaborative service.

Clients are expected to communicate professionally and provide timely feedback, information and approvals where needed.

Design Shake reserves the right to terminate a subscription where there is abusive behaviour, persistent non-payment or another serious breakdown in the working relationship.

20. Portfolio & Brand Acknowledgement

Unless you ask otherwise, you give Design Shake permission to display completed work and your company logo as examples of previous or current client work.

This may include use on the Design Shake website, portfolio, social media or other marketing materials.

This does not imply an endorsement or partnership.

Confidential or unreleased projects will not knowingly be published before launch without permission.

You may ask for your logo or work to be removed from Design Shake marketing at any time.

21. Changes to These Terms

Design Shake may update these Terms of Service from time to time.

Changes will not retrospectively alter a billing period that has already been paid for.

Where a significant change affects an active subscriber, reasonable notice will be provided before the change takes effect.
